2. The petitioner seeks bail in connection with Dhamoul P.S. Case No. 40 of 2025 instituted for the offences punishable under Sections 126(2), 117(2), 109(1) and 3(5) of the BNS.

3. As per the prosecution case, the allegation against the petitioner along with other co-accused persons are that they assaulted with lathi, khanti and iron rod upon the son of the informant with an intention to kill him.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that there is general and omnibus allegation against the petitioner. He further submits that Adhin Ravidas assaulted by Sabla on the eye of

Patna High Court CR. MISC. No.48071 of 2025(3) dt.08-10-2025 2/3 Sanoj Kumar, who is the son of the informant. He further submits that there is no any witness who has supported the allegation against the petitioner. Petitioner is in custody since 20.05.2025.

5. Learned APP for the State and learned counsel for the informant vehemently opposed the prayer for bail and submits that petitioner does not deserve the privilege of bail.

From perusal of the FIR, case diary, injury report and the impugned order of the learned District and Additional Sessions Judge-IX, Nawada dated 06.06.2025, it appears that there are two injuries found on the body of the informant's injured son Sanoj Kumar. From perusal of the injury report at para 124, it also appears that two injuries are found on the body of the injured son Sanoj Kumar, which are lacerated wound 7cm x 2cm frontal region on head. Small lacerated wound injury around left eye. NCCT brain is fracture red in lateral wall of left bony or bit left eye ball of orbital, so considering all these aspects of the case and submissions of learned counter for the petitioner, I am inclined to enlarge the petitioner on bail.

7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two
