ANJANA MISHRA ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehends his arrest in connection with Bairiya P.S. Case No. 29 of 2017 for the offences registered under Sections 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner was taken by the brother of one coaccused Kundan Kumar from whose possession the alleged recovery of motorcycle was made. It is further submitted that on the statement made by the said brother, the petitioner has been named in connection with the present case. Considering the aforesaid facts and circumstances of the

No.32055 of 2017 (2) dt.20-07-2017 case and that there is no recovery from the possession of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.,IV, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 29 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
