The petitioner seeks bail in Bheldi P.S. Case No. 41 of 2013, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The informant made specific allegation that the petitioner and his wife fired. The brother of the informant got firearm injury and one Sujit Kumar also got firearm injuries. Brother of the informant died.
Learned counsel for the petitioner submits that the petitioner and his wife are alleged to have fired, but the wife of the petitioner has already been granted anticipatory bail. There is very specific allegation against the petitioner that he fired which hit on the chest of the brother of the informant.
Patna High Court Cr.Misc. No.42067 of 2014 (3) dt.09-02-2015 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. However, the trial court is directed to expedite and conclude the trial within one year from the date of receipt/production of a copy of this order, if the trial is not concluded the petitioner may renew his prayer for bail firstly before the court below.
