The petitioners seek bail in a case registered for the offences under Sections 382 and 411 of the Indian Penal Code. The informant Ashok Kumar lodged a case against unknown for committing theft in Central Store Room of R.C.D.

Patna High Court Cr.Misc. No.42260 of 2014 (3) dt.13-02-2015 2/2 (Mechanical), Muzaffarpur and alleged that many parts of the road roller were stolen.

Learned counsel for petitioners submits that the petitioners are not named in the F.I.R.. Nothing was recovered from the possession of the petitioners. Petitioners are in jail since 18.07.2014.

It appears that the petitioners were apprehended while unloading the truck and many stolen articles were recovered. It also appears that the petitioners are in jail for more than six months and they have got no criminal antecedents. Considering the fact that the petitioners are in jail for more than six months, the petitioners, named above, are directed to be enlarged on bail on furnishing bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Muzaffarpur Town P.S.
