JUSTICE PRABHAT KUMAR JHA ORAL ORDER 18-10-2017 This petition is filed for modification of order dated 22.11.2016 and for extension of time to surrender the petitioners in the court below.
Learned counsel for the petitioners submits that the petitioners could not surrender in the court below due to some unavoidable circumstances but petitioners have not stated anywhere as to what was the unavoidable circumstances. The petitioners do not even annex any medical certificate showing their illness. The petitioners were granted anticipatory bail vide order dated 22.11.2016 but petitioners remained casual and did not surrender in the court for about ten months and filed this petition for modification only on 20.9.2016.
Considering the facts aforesaid, I do not find any reason
Patna High Court Cr.Misc. No.47601 of 2017 (2) dt.18-10-2017 2/2 to extend the period of surrender of the petitioners. Accordingly, the modification petition is dismissed. If the petitioners surrender in the court below, the learned court below shall consider the prayer for regular bail of the petitioner taking into consideration that the petitioners were granted anticipatory bail on merit and dispose of the regular bail petition of the petitioners preferably on the same day.
