The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341/323/354/504/506/379/34 of the Indian Penal Code. The animals of the petitioners were damaging the maize of the informant in presence of the petitioners. Allegation is that the act of the petitioners was deliberate and when they were forbidden by the informant they committed abuse, assault and theft as well as attempt to outrage the modesty of the informant and her daughter. Considering the background and nature of the allegation and after hearing of the parties, in my view, the

No.32222 of 2017 (2) dt.24-07-2017 2/2 petitioner deserves anticipatory bail, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Darbhanga/Successor Court in connection with Sakatpur Police Station Case No.47 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
