JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-02-2015 Petitioner, Dhananjay Kumar @ Triloki Prasad, seeks bail in Pirbahore P.S. Case No.215 of 2014, registered for the offences punishable under Sections 302 and 120B read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant, wife of the deceased, suspected the hands of the petitioner and other two accused persons in killing her husband Dhiraj Kumar.

Learned counsel for the petitioner submits that there is absolutely no evidence that the informant is an eye-witness of the occurrence. The Investigating Officer has not collected any sort of evidence in the entire case diary and except suspicion, no material has been collected.

On perusal of the record it appears that the informant

Patna High Court Cr.Misc. No.42395 of 2014 (3) dt.16-02-2015 2/2 only raised suspicion that Ravi Gope, petitioner and Guddu Barnwal must have committed murder of her husband. Similarly in her further statement, she reiterated the same facts. Even during course of investigation, the Investigating Officer did not collect any tangible evidence.

Considering the facts and circumstances, petitioner, Dhananjay Kumar @ Triloki Prasad, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Pirbahore P.S. Case No.215 of 2014.
