2. The petitioner apprehends his arrest for the offences alleged under Sections 399, 402, 413, 414 of the Indian Penal Code and 25(1-b)A/26/35 of the Arms Act registered in connection with Phulparas P.S. Case No. 184 of 2017.

3. It is submitted that one of the arrested persons, Md. Ismail, has named one Ram Sah @ Sri Ram Sah from whom he is said to have purchased a pistol. It is submitted that the name of the petitioner is Ram Prasad Gupta and he is not Ram Sah @ Sri Ram Sah nor has any concern with such person. Charge sheet has also been filed against Ram Sah.

4. Learned APP on the basis of the case diary submits that processes under Section 82 and 83 Cr. P.C. have been

Patna High Court Cr.Misc. No.56179 of 2018(3) dt.23-01-2019 2/2 concluded against Ram Sah @ Ram Prasad Sah having same parentage as the petitioner.

5. Having regard to the submissions of the parties, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The anticipatory bail petition stands dismissed. (Vikash Jain, J) Ibrar/BT U T
