2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 342, 323, 337, 353, 379, 504 and 506 of the Indian Penal Code.
3. The allegation against the petitioner in the F.I.R is that of illegal mining and transportation of mines and minerals. Further allegation is of disrupting government work by attacking and abusing government employees.
4. At the outset, learned counsel for the petitioner submits that the F.I.R has been lodged belatedly, which would
Patna High Court CR. MISC. No.45651 of 2025(2) dt.11-07-2025 2/3 be evident from the fact that the Court's endorsement on the F.I.R dated 04.04.2024 is on 09.04.2024. Further, there is no specific allegation against the present petitioner and the attention of the Court has been drawn to Annexure-2 annexed to the present application, by way of which three co-accused persons,namely, Gulshan Panday, Biru Pandey and Nirala Pandey who were named in the F.I.R., have already been granted privilege of anticipatory bail by orders dated 11.09.2024 and 23.10.2024 passed in Cr. Misc. Nos.57670 of 2024 and 67580 of 2024 respectively. The petitioner has no criminal antecedent and undertakes to co-operate in investigation/trial.
5. Learned APP for the State opposes the prayer for anticipatory bail application.
6. Taking into consideration the above mentioned facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Bhojpur, in connection with Sikarahatta P.S. Case No.41 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal
Patna High Court CR. MISC. No.45651 of 2025(2) dt.11-07-2025 3/3 Procedure/Section 482 (2) of the B.N.S.S., 2023 and subject to the further condition that the petitioner shall co-operate in the investigation/trial.
