Apprehending their arrest in Sherghaty (Dobhi) P.S. Case No. 91 of 2017 registered under section 302/34 IPC, the petitioners seek anticipatory bail.

The brother of the informant was killed and thrown on the road while he was attending a marriage function in the house of the father-in-law.

The contention is that the informant is not an eyewitness. The deceased had strained relationship with his wife who is also a co-accused.

From the impugned order, it appears that witnesses, in course of investigation, have supported the prosecution case.

Patna High Court Cr.Misc. No.33657 of 2017 (3) dt.20-07-2017 2/2 In my view, it is not a fit case for grant of anticipatory bail. Prayer is accordingly rejected.

The petitioners shall surrender and pray for regular bail which shall be considered and disposed of on its own merit in accordance with law.
