JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-07-2017 The appellant seeks pre arrest bail in connection with Sheohar SC/ST P.S. Case No. 07 of 2017, registered for offences punishable under Sections 341, 323, 324, 504, and 506 of Indian Penal Code and section 3(i)(r)(s) of SC/ST (POA) Act. Allegation against the appellant and other accused person is that they came abused the informant by taking his caste name and also allegation against other co-accused person that he gave knife blow to the informant.
It has been submitted on behalf of the appellant that there is dispute between the parties with regard to transaction of money and due to which the informant has filed this present false case against the appellant and no such occurrence as alleged has ever taken place.

Patna High Court CR. APP (SJ) No.1989 of 2017 (2) dt.12-07-2017 2/2 Having heard both sides, in view of the fact that a prima facie case under the above mentioned Section of SC/ST Act is made out against the appellant, as such, this appeal is not maintainable.
Let appellant surrender before the special court and make prayer for regular bail and if any such application is filed, the special court after considering the submission of learned counsel for the appellant, shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court.
