JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-08-2024 The present writ petition has been filed seeking the following reliefs:- "(a). For issuance of a writ/order/ direction commanding the Respondents to remove the illegal construction erected on plot no. 3251, Khata no. 367, marked for Aahar(Pond) with an area of 13 Acres, situated at the village Rampur Uber Police Station Ghosi in the District of Jehanabad.

(b). For issuance of a direction upon the Respondent no.5 to initiate appropriate proceeding against the Respondent no.9 for

Patna High Court CWJC No.6145 of 2015(4) dt.14-08-2024 2/2 getting a community hall erected over the Aahar (Pond) which is a source of irrigation for the agricultural land."

At the outset, the learned counsel for the RespondentState has submitted, by referring to the counter affidavit, filed on behalf of the Respondents No. 5, 6 and 8 that upon verification made by the Anchal Amin and Revenue Staff, it has been found that there is no yatrished in C.S. Plot No. 3251, nonetheless, in case of any subsisting grievances, the petitioner can approach the Circle Officer, Ghosi, Jehanabad. 3.

Considering the aforesaid aspect of the matter, I deem it fit and proper to dispose off the present writ petition, while granting liberty to the petitioner to approach the Circle Officer, Ghosi, Jehanabad, in case of any subsisting grievances. (Mohit Kumar Shah, J) Ajay/- U
