Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302 and 120(B) of the IPC.

Prosecution case in brief is that, on 28/5/20 the brother of the informant, Anirudh Rai (now deceased) had gone to Riga Block but did not come back till 10 PM. After search he came to know that his brother has been killed by the petitioner along with other co-accused persons and dead body of his brother was found in unconscious position near the boring situated east of the village who was taken to hospital where the doctor declared him dead.

Informant is not eye-witness of the occurrence and only material that has come against the petitioner is that one Sanjha Devi, said that she was asked to make call by the petitioner in the presence of Mamta Devi. Learned counsel appearing for the State vehemently opposes the prayer for bail.

Considering the materials available on record against the petitioner, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- VI, Sitamarhi in connection with Riga P.S. Case No. 139/2020 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
