2. The petitioner apprehends arrest in connection with Akbarnagar P.S. Case No. 90 of 2017 dated 31.10.2017 instituted under Sections 25(1(a))/25(1-AA)/25 (1-B)(a)/26/35 of the Arms Act.

3. The allegation against the petitioner and nine others is of being party to manufacture of illegal firearms.

4. Learned counsel for the petitioner submitted that he was not caught at the spot and only on the basis of confessional statement of co-accused, he has been implicated. It was further submitted that nothing has been recovered from

Patna High Court Cr.Misc. No.57866 of 2018 dt.17-12-2018 2/2 him.

5. Learned A.P.P. submitted that the person who was caught at the spot has made the petitioner accused and, thus, he cannot plead innocence.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to enlarge the petitioner on anticipatory bail.
