2. The petitioner is seeking bail in connection with Jalalpur P.S. Case No. 218 of 2026, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per the allegation, altogether 15 litres of foreign liquor has been recovered from semi-constructed bathroom situated outside the house of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case. It has further been submitted that the alleged recovery has not been made from the conscious possession of the petitioner. It has further been submitted that the alleged place of recovery is an open space and is accessible to all. It has further been submitted

5. Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner.

6. Heard the parties and perused the records.

7. Considering the facts and circumstances of the case and the period of custody, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd, Exclusive Special Excise Judge, Saran at Chapra in connection with Jalalpur P.S. Case No. 218 of 2026.
