JUSTICE BIRENDRA KUMAR ORAL ORDER 11-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The Petitioner is apprehending his arrest in connection with Complaint Case No.C-1015 of 2014 registered for the offences punishable under Sections 323/498A of the Indian Penal Code and Section 3/4 of the D.P. Act, pending in the Court of Judicial Magistrate, 1st Class, Motihari, East Champaran. Petitioner is husband of the complainant.
Allegation is of demand of dowry and torture for the same including solemnization of second marriage with some other lady. The matter was sent for reconciliation, which has already failed.
Submission of the learned counsel for the petitioner is that for dispute relating to quantum of maintenance amount the
Patna High Court Cr.Misc. No.3036 of 2017 (4) dt.11-07-2017 2/2 mediation could not succeed.
Considering the nature of allegation, this is not a fit case for anticipatory bail. Hence, the prayer for anticipatory bail is refused.
