The Petitioner is apprehending his arrest in connection with Vaishali P.S. Case No.178 of 2016, registered for the offences punishable under Sections 376/323/324/34 of the Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Vaishali at Hajipur.
Allegation against the petitioner is that he induced the complainant to go with him to Mumbai for managing some job for the complainant and there the petitioner established physical relation on the pretext of marriage.
The reconciliation failed as the petitioner denied that he
Patna High Court Cr.Misc. No.9416 of 2017 (6) dt.11-07-2017 2/2 had any relationship with the complainant. The petitioner was not ready for marriage with the complainant, for which the complainant was insisting.
Considering the nature of allegation, in my view, this is not a fit case for anticipatory bail. Hence, the prayer for anticipatory bail is refused.
