21-01-2015 Heard learned counsel for the petitioner. None appeared on behalf of the State.
The sole petitioner, who is in custody since 26.10.2013 in connection with Hasanpur P.S. Case No.137 of 2013 registered under Sections 399, 402 of the Indian Penal Code and 25(1-B)A/ 26 /35 of the Arms Act, has prayed for grant of bail.
It was argued by learned counsel for the petitioner that though along with petitioner other six persons were apprehended by the police, from conscious possession of the petitioner nothing was recovered.
Keeping in view the period of custody and nature of accusation, let the petitioner, Santosh Yadav @ Ramesh Yadav be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten
Patna High Court Cr.Misc. No.42417 of 2014 (3) dt.21-01-2015 2/2 thousand) with two sureties of the like amount each to the satisfaction of Sri Krishna Kumar, Judicial Magistrate, 1st Class, Rosera, district-Samastipur in connection with Hasanpur P.S. Case No.137 of 2013 with conditions that (i) one of the bailors must be blood relation of the petitioner and (ii) during trial, the petitioner shall regularly appear before the court below. In case, during trial he fails to appear continuously on two dates without prior permission of the court, his bail bond shall stand automatically cancelled.
