====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-02-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Khajekalan Police Station Case No. 480 of 2018 registered for the offences punishable under sections 302/120B/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused Raju Yadav @ Raj Kumar are alleged to have fired upon the husband of the informant as a result of which he died. Learned counsel for the petitioner submits that due to dispute between the informant and co-accused Raju Yadav the petitioner being co-villager, has been implicated in this case. Informant is not the eye witness and Charge sheet has already been submitted. Ppetitioner is in custody since 11.6.2020.

Patna High Court CR. MISC. No.40816 of 2020(2) dt.26-02-2021 2/2 Learned counsel for the State opposes the prayer for bail and submits that the informant is the eye witness to the occurrence and there is allegation against the petitioner that he too fired at the husband of informant. Post mortem report supports the prosecution case.

In view of the specific allegation against the petitioner, his prayer for bail is refused.
