Petitioner seeks regular bail in connection with Kazi Mohammadpur P.S. Case No.86 of 2016, registered for the offences punishable under Section 394 of the Indian Penal code and Section 27 of Arms Act.

This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 15.01.2021 passed in Cr. Misc. No.30151 of 2021, with liberty to renew his prayer for grant of regular bail after six months. Prosecution story as per the FIR is that staff of the

No.56688 of 2021(2) dt.06-10-2021 2/3 informant had gone to deposit Rs.2,50,000/- in the State Bank of India at University campus, they were accosted by three unknown persons, who snatched the aforesaid amount after firing upon them, causing injury to the staff of the informant. Learned counsel for the petitioner submits that petitioner is not named in the FIR and he has been made accused on the basis of confessional statement made by coaccused, Ritesh Kumar and was remanded in this case from Ahiyapur P.S. Case No.1 of 2020 on 08.05.2020. Learned counsel next submits that except confessional statement, no other evidence is against the petitioner. He further submits that trial has not concluded as yet and the same is not likely to be concluded in the near future due to Covid-19 Pandemic.

Regard being had to the submission made by the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 08.05.2020 and the trial is not likely to be concluded in near future due to Covid-19 pandemic and this is second attempt for grant of regular bail on behalf of the petitioner, I am inclined to grant regular bail to the petitioner.
