This application, for grant of anticipatory bail, arises out of Mufasil Police Station Case No. 28 of 2017, disclosing offences under Sections 304(B)/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the deceased died due to an accident met with her resultantly she sustained burnt injury and succumbed to death during treatment. Due to accident the petitioner also sustained burnt injury along with the deceased and they were taken to Rajeshwar Hospital for treatment, which is evident from annexure-2 Series of the supplementary

Patna High Court Cr.Misc. No.37061 of 2017 (4) dt.18-09-2017 affidavit. As a matter of fact, occurrence took place on 26.11.2016 and the F.I.R. has been lodged on 02.02.2017 without explaining plausible delay. Hence, the petitioner deserves the privilege of anticipatory bail. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Munger in connection with Mufasil Police Station Case No. 28 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
