2. The petitioner has preferred this application for grant of regular bail in connection with K. Hat P.S. Case No. 194 of 2025, dated 14.05.2025 registered for the offences punishable under Sections 126(2), 127(2), 115(2), 308(2) and 308(5) read with Section 3(5) of the BNS.

3. As per the prosecution case, on 14.05.2025 at about 12:00 PM, the informant along with his friend was going to Max Hospital by car carrying Rs. 1,50,000/- in a bag to pay for the operation of his elder sister admitted in the said Hospital. It is further alleged that informant's car was stopped near Chhuni Urao Chowk by the patrolling party and the petitioner

Patna High Court CR. MISC. No.44924 of 2025(2) dt.30-07-2025 2/3 along with other persons took informant's bag and out of Rs. 1,50,000/-, they took Rs. 1,10,000/- and left the rest money. It is further alleged that when the informant demanded his money, he was threatened by them.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to ulterior motive. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner, rather the said amount is alleged to have been recovered from the possession of Aman Kumar @ Golu. It is further submitted that matter has been compromised between the parties and both the parties have filed a compromise petition before the learned trial Court with their signatures and both the parties do not want to proceed further with the case. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 14.05.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above-named, is directed to be enlarged on bail on

Patna High Court CR. MISC. No.44924 of 2025(2) dt.30-07-2025 3/3 furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia, in connection with K. Hat P.S. Case No. 194 of 2025, on further condition:

(i) The petitioner is directed to remain physically present before the learned trial Court on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

7. The application stands allowed.
