The petitioner seeks bail in a case registered under Sections 27b(ii)/28/28A of Drugs & Cosmetic Act, 1940. Allegation is that illegal drugs were seized from the house of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.3.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Certain medicines relating to veterinary is said to have been recovered. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Kankarbagh P.S. case No.261 of 2019.
