The petitioners seek anticipatory bail in Harsidhi P.S. Case No.50 of 2015, Tr. No.1926 of 2016 instituted for the offences under Sections 341, 447, 323, 324, 307, 504 and 379/34 of the Indian Penal Code.
It has been alleged that when the informant was standing at the Darwaja, petitioner came and started throwing wood and bricks from his land and when protest was made he assaulted the informant with Farsa.
Learned counsel for the petitioner submits that police has submitted the final form but the Court has taken cognizance.
Patna High Court Cr.Misc. No.32961 of 2017 (2) dt.21-07-2017 The Court has taken cognizance against the petitioner on the basis of the material available on record. There is direct allegation against the petitioner to have caused injury by Farsa. In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of four weeks from today, the court below will pass an order on the same day on its own merit without being prejudiced by the order passed by this Court.
