JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-10-2019 This is an application for grant of anticipatory bail in connection with Bakhtiarpur P. S. Case No. 364 of 2015, disclosing offences under Sections 420, 467, 468, 323, 427, 504, 34 of the Indian Penal Code.

From the perusal of the record, it appears that petitioners have earlier also came before this Court for grant of anticipatory bail and the application was disposed of, vide order dated 23.12.2016 passed in Criminal Misc. No. 28538 of 2016. Submission of the learned counsel for the petitioners is that later on a compromise has been reached between the parties and deed agreement has also been executed by the petitioner and as such, he has filed the fresh application.

Having heard both sides, considering the fact that as application for anticipatory bail of the petitioners was earlier disposed of, I am not inclined to grant privilege of anticipatory bail to the petitioners. However, if they surrenders and pray for regular bail, the learned court below shall consider the above submission that a compromise has been reached between the parties and deed of agreement has also been executed by the petitioner also, considering the aforesaid, he will pass an appropriate order, if possible on the same day.
