The petitioner is apprehending his arrest in a case registered under Sections 363, 364, 302 and 201/34 of the Indian Penal Code.
The prosecution case, in short, is that the accused persons came to the house of the informant and took her daughter for marriage purpose and thereafter caused death of his daughter.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. This is a case of last seen. The deceased is said to
Patna High Court Cr.Misc. No.55425 of 2018(3) dt.03-12-2018 2/2 have gone along with the petitioner and others. Subsequently, after two days, her dead body was found. There is no eye witness to the alleged occurrence. There is no allegation in respect to the offence under Section 364 of the Indian Penal Code.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 51/18, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Pankaj/- U T
