The petitioner seeks bail in connection with Khagaria (Muffasil) P.S. Case No. 350 of 2022 dated 23.04.2022 vide Special Case No. 20 of 2022 instituted for the offences under Sections 399, 402, 307, 323 and 332 of the Indian Penal Code and Sections 25(1-b)a, 26, 27/35 of the Arms Act and Sections 20/22 of the NDPS Act.

On secret information that miscreants have assembled at the house of one Kranti Devi, a raid was conducted in which the petitioner along with others were arrested. From the house in question, 2kg and 300 gms of Ganja was also recovered. From the possession of the

Patna High Court CR. MISC. No.47427 of 2022(2) dt.16-12-2022 2/2 petitioner, only one mobile phone and a sharp cutting weapon of the nature of an axe was recovered. The learned counsel for the petitioner has submitted that he is in custody since 24.04.2022 and has no criminal antecedents. He has further submitted that two other accused persons of this case, similarly situated, have been granted bail by different Benches of this Court. He further submits that no offence under NDPS Act can at all be said to have been made out against him.

Regard being had to the aforenoted facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions JudgeV-cum-Special Judge, NDPS, Khagaria in connection with Khagaria (Muffasil) P.S. Case No. 350 of 2022 vide Special Case No. 20 of 2022.
