JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 2.4.2014 in a case registered for the offences punishable under Sections 447,341,323,324,307,379,504 and 506/34 of the Indian Penal Code. Subsequently, section 302 IPC was added. It is alleged that six persons came, took away the tractor along with the informant. Subsequently they caused injury with chhura to the informant. When the informant tried to flee away after jumping from the tractor, he was being crushed by Shrawan Sah who was driving the tractor. The informant identified four persons including Mintu Sah, Raman Sah, Sharwan Sah and this petitioner. Subsequently the informant succumbed to the injury. It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.33355 of 2014 (3) dt.12-01-2015 2/2 that no overt act has been alleged against this petitioner. The accusation of causing injury by dagger is against Sunil Kumar and others whereas Sharwan Sah crushed the informant. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that co accused Raman Sah has been granted bail vide Cr. Misc. No. 20042 of 2014. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge I, Munger in connection with S.T. No. 437 of 2014 arising out of Bariyarpur P.S. Case No. 132 of 2013.
