JUSTICE SHIVAJI PANDEY ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In the present case, the petitioner was appointed as Store Keeper in Bihar Paper Mill, Saharsa, but as it appears that the Paper Mill could not run and ultimately closed. The question in the present case has been raised who would pay the amount to the petitioner. Earlier the view was that as the Paper Mill is a corporate body is only liable to pay the amount. Ultimately, the Division Bench has directed for the payment of amount to the other person by the State of Bihar on the ground that it is a creation of the State of Bihar. This question is not required to be gone into in the present dispute as the petitioner has been paid an amount of Rs.7, 34,919/-. As per the claim of the petitioner, he is entitled to Rs.20,44,000/-.

Patna High Court CWJC No.4073 of 2013 (4) dt.12-01-2016 2/2 As per the claim of the respondent-company, the entire amount has been paid to the petitioner and nothing further is to be paid by respondent-company. However, the petitioner has annexed the chart, showing the amount of entitlement that will be examined by the respondent-Company. If the respondent-company finds that any extra amount is required to be paid to the petitioner, the respondent-company will pay the same to the petitioner but that amount will not carry any interest.

The respondent-Company is directed to complete the exercise within a period of three months from the date of receipt/production of a copy of this order.

With the aforesaid observations and directions, this writ petition stands disposed of.
