The petitioner seeks bail in connection with Special Case No.77 of2020 arising out of Malsalami P.S. Case No. 146 of 2020 registered for the offences punishable under Sections 399/402 of the Indian Penal Code, Sections 25(1-b)a/26/35 of the Arms Act and Sections 20/22 of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that according to the F.I.R., one loaded country made pistol and one live cartridge has been recovered from the
Patna High Court CR. MISC. No.1377 of 2021(2) dt.04-03-2021 2/2 conscious possession of the petitioner and other contraband article has been recovered from the other accused persons. Learned counsel for the petitioner further submits that the petitioner is in jail custody since 02.06.2020. Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, since the petitioner is in jail custody for more than six months, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned C.J.M., Patna in connection with Special Case No.77 of 2020 arising out of Malsalami P.S.
