2. The petitioner seeks regular bail in connection with Vigilance P.S. Case No. 32 of 2025 registered for the offence under Section(s) 7(a) of the Prevention of Corruption Act.

3. As per the prosecution case, the petitioner is accused of taking Rs. 3 Lakh bribe in liue of mutation.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 24.05.2025. He further submits that the petitioner being a government servant has already been suspended and the charge-sheet has been submitted and there is no allegation of any tampering of evidence by the vigilance.

5. Learned counsel for the Vigilance has vehemently

Patna High Court CR. MISC. No.47069 of 2025(5) dt.17-10-2025 2/2 opposed the prayer for bail by submitting that since the amount involved is huge, therefore, the petitioner doesn't deserve the privilege of bail.

6. I have heard and considered the submissions of the parties and have also gone through the materials available on record. The petitioner has suffered an imprisonment of five months and the charge-sheet has also been submitted.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance, North Bihar, Muzaffarpur/concerned Court below in connection with Vigilance P.S. Case No. 32 of 2025 subject to conditions that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bonds of the petitioner.
