Heard the learned counsel for the petitioner as well as the learned APP for the State through video conferencing.

In this case, the petitioner is seeking regular bail in connection with Daudnagar P.S. Case No. 47 of 2022, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 504 and 506 and subsequently 302 IPC have been added.

As per allegation, the informant who is a police

Patna High Court CR. MISC. No.47511 of 2022(2) dt.09-12-2022 2/3 sub-inspector proceeded for investigation of Daudnagar P.S. Case No. 37 of 2022, in course of investigation, he received location of mobile no. 7461049533. As per location, the informant along with police party went there. A police personnel attempted to interrogate accused Ravi Kumar, in the meantime, the residents of nearby assembled there and they raised angry and aggressive voice against the police personnel. Sixteen FIR named accused persons attacked the police party in which some police personnel sustained injuries and a sub-inspector namely Birendra Paswan died during course of treatment.

Learned counsel for the petitioner has submitted that nearabout 15 accused on similar footing have been granted bail by the coordinate Bench of this Court. The petitioner is a person of clean antecedent and he is under custody since 28.01.2022.

Considering the above-mentioned facts and circumstances and also considering that nearabout all the accused persons have been granted regular bail and the petitioner is under custody since 28.01.2022, let the petitioner, above-named, be released on bail on furnishing

No.47511 of 2022(2) dt.09-12-2022 3/3 bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 47 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
