The petitioner seeks bail in Chautarwa (Bathwariya) P.S. Case No. 51 of 2021, registered for the offence punishable under Sections 366A, 363 of the Indian Penal Code and section 8 of the POCSO Act.

As per prosecution case, petitioner along with other co-accused persons enticed away the minor daughter of the informant for the purpose of marriage.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. There is love affair between the victim girl and this petitioner. The victim in her statement under Section 164 Cr.P.C has stated that out of her own will she left her house and went along with this petitioner. They have also solemnized marriage and she disclosed her age

Patna High Court CR. MISC. No.56498 of 2021(2) dt.07-12-2021 2/2 to be 18 years. Petitioner is in custody since 07.07.2021 having clean antecedent.

In view of statement of victim girl under Section 164 Cr.P.C, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Addtional District & Sessions Judge-cum-Special Judge POCSO, Bettiah, West Champaran in connection with Chautarwa (Bathwariya) P.S.
