JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No.1165 of 2016 registered under Section 498(A) of I.P.C. and Section 3⁄4 of Dowry Prohibition Act. Accusation is of torturing of the complainant, O.P.No.2 by her husband and other in-laws for non-fulfillment of demand of dowry of Rs.50,000/- and removing her from her matrimonial house after snatching her all belongings.

Learned counsel appearing on behalf of the petitioner submits that on the prayer of the petitioner and O.P.No.2 the

Patna High Court Cr.Misc. No.19972 of 2017 (3) dt.04-09-2017 2/2 matter was referred to the Patna High Court Mediation Centre where the parties decided to live together. Accordingly, the petitioner took his wife to her matrimonial house. But after fifteen days she left her matrimonial house calling her brother. Having considered the facts and the circumstances of the case and submission as above made by the parties, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Gaya, in Complaint Case No.1165/16 subject to the conditions as laid down under Section 438(2) Cr.P.C.
