Mr. Ashok Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 22-06-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 341/323/324/307/504/34 of the Indian Penal Code.
Due to free-fight between the two parties there is case and counter case. Petitioner allegedly caused farsa blow to Munna Thakur causing injury at the head. The doctor has found laceration at the head caused by hard and blunt substance. Submission is that the petitioner is in custody since 29.09.2020 and investigation of the case is already complete. The medical report is not consistent with the prosecution allegation against the petitioner.
Considering the facts of the case aforesaid especially completion of investigation and no material to substantiate that

No.1223 of 2021(4) dt.22-06-2021 2/2 the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Gopalpur P.S. Case No.16 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
