The two petitioners in this case are aggrieved by and dissatisfied with the order dated 07.10.2017 passed by learned A.D.J.-I, Danapur in connection with Sessions Trial No. 782 of 2008 arising out of Bihta P.S. Case No. 152 of 1996 under Section 307/34 IPC and Section 27 of the Arms Act. The petitioners have been declared absconders and permanent warrants have been issued against them. After some arguments, learned counsel for the petitioners submits that these petitioners are ready to submit themselves to the jurisdiction of the learned court below and they shall surrender within a period

Let the petitioners surrender in the learned court below within a period of three weeks and file an appropriate application in the trial court itself. If any such application is filed upon surrender within the aforesaid period, the same will be considered by the learned trial court in accordance with law. Let it be recorded that this Court has not gone into the merit of the contentions of the petitioners and the same shall be opened for consideration and this order shall not be construed as granting any interim relief to the petitioners.
