====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 04-08-2025 Heard Mr. Vijay Kumar, learned counsel for the Petitioner and Binod Kumar No. 3, learned APP for the State.

2. Petitioner seeks regular bail in connection with Vaishali P.S. Case No. 256 of 2025 dated 03.05.2025 registered for the offences punishable under Sections 127(6), 143(3), 144(2), 64, 61(2) of the BNS and Sections 3, 4, 5, 6, 7 & 8 of the Immoral Traffic (Prevention) Act.

3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to immoral activity which was allegedly running at three hotels though the petitioner was apprehended from one of the hotel alongwith a girl Veena Kumari, but in fact he and the said girl went to the said hotel bonafidely and their marriage had been fixed at that time and they were going to solemnize marriage and in this regard specific statement has been made in the paragraph no. 7 of the petition. It is further submitted that the petitioner has been languishing in jail

Patna High Court CR. MISC. No.47454 of 2025(2) dt.04-08-2025 2/2 since 4.5.2025 and he has no connection to the alleged hotel and against him the investigation has been completed. It is lastly submitted that one co-accused namely, Dipak Kumar carrying similar nature of allegation, has been granted bail by a co-ordinate bench of this Court vide order dated 16.07.2025 passed in Cr. Misc. No. 43418 of 2025.

4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

Considering the aforesaid submissions and mainly petitioner's aforesaid defence as to he and one Veena Kumari were present at the alleged hotel bonafidely and their marriage was to be solemnized very soon and coupled with petitioner's custody period and completion of investigation against him, this court is inclined to release him on bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Vaishali P.S. Case No. 256 of 2025.
