The petitioner seeks bail in a criminal prosecution registered under Sections 302 and some other allied offences of the Indian Penal Code.
As per the prosecution case, the petitioner is said to have confessed his guilt leading to the recovery of the dead body. In above view of the matter, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of bail. His prayer for bail in connection with Motipur P.S. Case No. 175 of 2014, dated 16.06.2014, pending in the court of learned S.D.J.M. (West), Muzaffarpur, is rejected for the present. Learned court below is hereby directed to commit the case to the court of Sessions, if not already committed, and after such commitment endeavour shall be made to conclude the trial of the petitioner at an early date preferably within a period of nine months from the date of commitment of the case. However, if the trial is not concluded within the aforesaid period, then the petitioner shall be at liberty to renew his prayer for bail. (Birendra Prasad Verma, J) BTiwary/- U T
