Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under

Patna High Court CR. MISC. No.56267 of 2021(2) dt.20-04-2022 2/3 Sections 147, 341, 323, 380, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioners seeks permission to withdraw the petitioner with regard to petitioner Nos. 1, 3 and 4 namely Ajay Yadav @ Ajay Kumar Yadav, Renu Devi and Sudama Devi since they have been arrested.

Permission is accorded.

Accordingly, the petition with respect to petitioner Nos. 1, 3 and 4 is dismissed as withdrawn. The accusation is of making assault to the informant and her husband by all the accused persons including petitioner No. 2.

It is submitted by learned counsel for the petitioners that the accusation against petitioner No. 2 is general and omnibus and in the background of some land dispute, the present F.I.R has been registered. Moreover, there is no injury report on record nor there is any description of any injury in the impugned order. A

Patna High Court CR. MISC. No.56267 of 2021(2) dt.20-04-2022 3/3 statement has been made in para 3 of the petition that petitioner No. 2 has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner No. 2, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Supaul in connection with Pipra P.S. Case No. 32 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
