JUSTICE SANJAY PRIYA ORAL ORDER 30-08-2017 Heard learned counsel for the petitioner and the State. This application has been filed for modification of the order dated 12.05.2017 passed by this Court in Cr. Misc. 6675 of 2017 seeking extension of time to surrender the petitioner before the court below.
It has been submitted that earlier petitioner could not furnish bailors because the court below was not accepting the same and so, he filed petition for modification of the order, which was disposed off by this Court on 12.07.2017 passed in Cr. Misc. 31539 of 2017. Hence, the time given by this Court to petitioner to surrender in Cr. Misc. 6675 of 2017 has expired. In such circumstances, four weeks' further time from the date of receipt of this order, is given to the petitioner, to surrender in the court below and the petitioner will be released by
Patna High Court Cr.Misc. No.40871 of 2017 (2) dt.30-08-2017 2/2 the court below on same terms and conditions as mentioned in the order dated 12.05.2017 passed in Cr. Misc. 6675 of 2017. The application stands allowed.
It is made clear that no further extension will be given to the petitioner.
Let this order be communicated to the Judicial Magistrate, 1st Class, Patna, in connection with Budha Colony P.S. Case No. 295 of 2016.
