JUSTICE SANJAY PRIYA ORAL ORDER 17-07-2017 Heard learned counsel for the petitioner and learned Addl. Public Prosecutor for the State.

The petitioner apprehends her arrest in Nawada Town P.S. Case No. 723 of 2016 instituted for the offence under Sections-272/ 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition & Excise Act, 2016.

It is alleged that 37 cartoons of foreign liquor 375 ml. each have been recovered from a pick up van, which belonged to the petitioner. The driver of the vehicle disclosed that the husband of the petitioner with other persons, is indulged in sale and purchase of illicit liquor from Jharkhand to Bihar. As such, there is recovery of foreign liquor in huge quantity from the vehicle which was registered in the name of the

In such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected.

The petitioner is directed to surrender in the court below and seek regular bail, which will be considered by the court below on its own merit without being prejudiced by this order. (Sanjay Priya, J) A.K.V./- U T
