Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered in connection with Kochadhaman P.S.Case No. 35 of 2021 for the offences punishable under Section 302 of the Indian Penal Code. As per the prosecution case, it is alleged that on account of some triffling issues, the petitioner assaulted his step sister by means of lathi over her head and other vital part of the body, which resultant into her death.

It is submitted on behalf of the learned counsel for the petitioner that petitioner has no intention to cause such

Patna High Court CR. MISC. No.56764 of 2021(3) dt.11-05-2022 2/2 injury to the deceased. It is submitted that had the deceased treated immediately, she could not have died but because of negligence on the part of the family members in providing any medical aid, she died.

On the other hand, learned counsel for the State opposed the bail application of the petitioner. Considering the nature of allegation, this Court not inclined to enlarge the petitioner on bail and hence, his prayer for bail in connection with Kochadhaman P.S.Case No. 35 of 2021 stands rejected.
