The order dated 22.01.2016 is corrected to the extent that in paragraph No.2 of the first page the word "preceded" will be read as "proceeded".

In this case, the petitioner is seeking reinstatement to the post of Shiksha Mitra, as has been claimed that the petitioner have been terminated illegally.

The persons who were holding the post of Shiksha Mitra at the time of enforcement of Bihar Panchayat Elementary Teachers (Employment and Conditions), Rules, 2006, have been converted as Panchayat Teachers in view of Rule 20(iii) and no mechanism has been provided in the Rule for adjudicating the grievance of the Shiksha Mitra.

In such view of the matter, this court cannot proceed with the matter in view of the judgments passed in the case of Smt. Renu Kumari Pandey vs. State of Bihar & Others, reported in 2011(4), PLJR, 297 and in the case of Kalpana Rani vs. State of Bihar & Others, reported in 2014(2), PLJR, 665.
