This application, for grant of anticipatory bail, arises out of Muffasil P.S. Case No. 137/2017, disclosing offences under Sections 341, 323, 308, 354, 379 and 504/34 of the Indian Penal Code.
From the First Information Report, it appears that some dispute had arisen out of an electric pole being installed at a particular place whereupn the occurrence took place. It is alleged that petitioner no. 5 inflicted Khanti blow on the head of the informant. So far another petitioners are
Patna High Court Cr.Misc. No.48781 of 2017 (2) dt.16-11-2017 2/2 concerned, they are said to have assaulted the informant with Lathi etc.
Considering the genesis of the occurrence and the nature of accusation, this application is allowed. Let the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Muffasil P.S. Case No. 137/2017, subject to the condition laid down under Section 438(2) of the Cr.P.C. This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
