The petitioners seeks bail in Special Case No. 40 of 2018 arising out of Rupaspur P.S. Case No. 162 of 2018, instituted for the offence under Section(s) 395, 397, 412 of Indian Penal Code, Section 22 of N.D.P.S. Act, Sections 25(1b)a, 26 and 35 of Arms Act. It is alleged in the written report that Police got information on his Mobile phone by a lady that dacoity has been committed in her Nursing Home. The informant along with other Police personnel reached there. Petitioners along with other accused persons were arrested from the Nursing Home. It

Patna High Court CR. MISC. No.43886 of 2019(2) dt.19-07-2019 2/2 is further alleged that one knife and Gupti were recovered from possession of the petitioners. Some white powder kept in the pocket was also recovered which seems to be Smack. Counsel for the petitioners submits that there is no report of FSL. Charge sheet against the petitioners has already been submitted. He further submits that co-accused Prince Kumar has already been granted bail by coordinate Bench of this Court vide order dated 16.4.2019 passed in Cr. Misc.21949 of 2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-VI, Patna, in connection with Special Case No. 40 of 2018 arising out of Rupaspur P.S.
