JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is languishing in custody since 18.12.2013 in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after three years of marriage.

Considering the fact that postmortem report suggests the cause of death as strangulation, this court is not inclined to grant bail to the petitioner in connection with S.T. No. 305 of 2014 arising out of Gaighat P.S. Case No. 319 of 2013 pending in the court of the learned 2nd Adhoc Addl. Sessions Judge, Muzaffarpur.

Patna High Court Cr.Misc. No.33334 of 2014 (3) dt.12-01-2015 This application is, accordingly, dismissed. However, if the trial is not concluded within one year, the petitioner may renew his prayer for bail.
