The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Recovery is of 30 liters of country made liquor. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has falsely been implicated in this case. He further submits that the recovery has been made from the bag kept on the motorcycle, in fact, nothing has been recovered from the conscious possession of the petitioner but on the basis of disclosure made by the local chaukidar,

2/4 he has been implicated in this case. He further submits that the petitioner has no concern at all with the alleged recovery and the motorcycle in question rather the owner of the motorcycle is Raja Paswan who is also a co-accused in this case. This Court is aware of the decision of the Full Bench rendered in the case of Ram Vinay Yadav vs. State of Bihar reported in 2019(2) PLJR, 1089. Having regard to the law laid down in the aforesaid judgment and the submission advanced on behalf of the parties, this Court, for the limited

3/4 purpose of grant of anticipatory bail, is inclined to accept the submission of counsel for the petitioner.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty

4/4 to move for cancellation of bail.

And, further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
