The present MJC application has been filed on behalf of the petitioner for restoration of MJC No. 4130 of 2013, which stood dismissed for want of prosecution by order dated 11.12.2013.

Despite valid service of notice, opposite party no.5 has chosen not to appear and not to controvert the averments made in the present MJC application.

In above view of the matter, after having heard the learned counsel for the petitioner as also the learned State counsel appearing on behalf of the respondent nos. 1 to 4 and for the reasons disclosed in the present MJC application, the prayer for restoration is allowed. MJC No. 4130 of 2013 is directed to be restored to its original file, subject to deposit of cost of

Patna High Court MJC No.6378 of 2013 (5) dt.03-02-2016 2/2 Rs.2,000/-(Rupees two thousand) by the petitioner within a period of four weeks from today with the Patna High Court Legal Services Committee, Patna.

If the receipt showing deposit of cost is filed within the aforesaid period of time, MJC No. 4130 of 2013 shall be restored to its original file and MJC No. 4130 of 2013 shall be listed under the heading "For Admission".
