====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-07-2025 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the opposite party no. 2.

2. Learned counsel appearing on behalf of the opposite party no. 2 at the outset submits that the case was taken up on 18.07.2025 and a non-bailable warrant of arrest was issued for bringing the opposite party no. 2 to the Court for the reasons recorded in the order dated 18.07.2025. It is further submitted that opposite party no. 2 has appeared. The Station House Officer and the Investigating Officer are present.

3. Learned counsel appearing on behalf of the petitioner submits that the instant cancellation application was filed seeking cancellation of anticipatory bail granted to the opposite party no. 2

Patna High Court CR. MISC. No.55379 of 2024(7) dt.25-07-2025 2/2 herein by an order dated 18.03.2024 in Cr. Misc. No. 63102 of 2023 as the opposite party no. 2 was violating the conditions of anticipatory bail but then fairly submits that the grievance of the petitioner stands redressed and does not seek to pursue the cancellation application any further and thus seeks permission to withdraw the cancellation application.

4. In view of the submissions made by the learned counsel appearing on behalf of the petitioner and the fact that opposite party no. 2 has appeared and the petitioner does not intend to pursue the cancellation application any further and seeks permission to withdraw the same, as such, permission is accorded.

5. The instant cancellation application is permitted to be withdrawn.

6. The non-bailable warrant of arrest issued, vide order dated 18.07.2025, is hereby recalled.

7. The Station House Officer and the Investigating Officer of the case are present in the Court, their personal appearance is dispensed with.
