2. The petitioner is apprehending arrest in connection with Muffasil P.S. Case No. 283 of 2022 registered on 01.05.2022 for the offenses punishable under Sections 406, 409, 420 read with Section 34 of the Indian Penal Code, learned CJM, Gaya.

3. Prior to argument, learned counsel for the petitioner fairly submits that the petitioner has earlier moved for anticipatory bail which was rejected vide order dated 28.07.2023 passed in Cr. Misc. No. 41059 of 2023. As such, he seeks permission to withdraw the present bail application since the second anticipatory bail is not maintainable.
